Waiver of Liability and Assumption of Risk: Off-Grid Ranch Retreat

 

By booking or entering Vulture Ranch, guests acknowledge and agree to the following terms and conditions.

 

1. Assumption of Inherent Risks (Off-Grid and Natural Environment)

 

Guests acknowledge that Vulture Ranch operates as a remote, off-grid property, and the activities and presence on the property entail known and unanticipated risks, some of which cannot be eliminated regardless of the care taken. These inherent risks are an integral part of the retreat experience.

 

Risks of the Property and Activities Include, but are not limited to:

• Natural Hazards and Wildlife: Exposure to natural elements and hazards, including but not limited to uneven terrain, erosion, varying road and trail conditions, and natural obstacles. This includes risks associated with regional wildlife, insects, and reptiles, such as snakes, spiders, ticks, scorpions, and predatory animals.

• Off-Grid Systems: Potential risks and inconveniences associated with off-grid living, including but not limited to:

  • Fluctuations or interruptions in power (solar/generator) or water supply (well/cistern).

  • Limited or intermittent cellular service and Wi-Fi access.

  • Failures in plumbing, septic, or waste management systems due to the remote nature of the property.

• Adverse Weather and Elements: Rapidly changing and adverse weather conditions, including extreme heat, flash floods, wind, and lightning.

• Activities: Risks associated with any activities offered or performed on the property, including but not limited to hiking, animal feeding/interaction, and using any on-site equipment.

2. Guest Responsibility and Acknowledgment

• Fitness and Health: Guests confirm that they are physically and mentally capable of undertaking the risks associated with a remote, off-grid environment.

• Property Rules: Guests agree to obey all posted signs and safety rules and to follow all directions and instructions given by Ranch personnel.

  ​

• Minors: Any adult bringing minors onto the property is solely responsible for supervising those minors at all times.

  ​

3. Release of Liability

 

In consideration for being permitted to access the Property and participate in the Activities, the undersigned, on behalf of themselves and their personal representatives, heirs, and assigns, does hereby fully and irrevocably release, waive, and forever discharge Vulture Ranch, LLC (and its owners, employees, agents, and affiliated entities) (collectively, the “Released Parties”) from any and all claims, actions, losses, and/or legal liability of any kind or nature resulting from damages or injuries (including death) sustained by the guest and/or their property arising out of or related to their presence or activities on the Ranch property.
